PERSONAL DATA AND PRIVACY ACT
Giga Shipping Sdn Bhd and the Giga Group of Companies (collectively “us” or “we”) respect your privacy and value the relationship we have with you. This Personal Data Notice (“Notice”) is issued pursuant to the Personal Data Protection Act 2010 (“PDPA”) to help you understand why we collect your personal data, how we handle your personal data and with whom we share such data, among others.

A. COLLECTION AND SOURCE OF PERSONAL DATA
Generally, the personal data that we collect comes from you when you contact us, register or transact with us, when you provide your personal data to any of our representatives directly or through your representatives, agents, forwarding agents or through one of our partner programmes or any other method, or otherwise interact us (whether by telephone, facsimile, online or otherwise). Apart from information provided by you, we may also obtain personal data on you from other sources, including but not limited to, publicly available sources, credit bureaux and credit reporting/referencing agencies, governmental departments, agencies or authorities, our business partners and your employer, representatives, agents, forwarding agents or related persons or organisations from whom such information would be essential for the proper processing of the data for the purposes stated herein. We may also collect additional data from you if is required. The personal data supplied may include but is not limited to information which you have previously provided us with or may subsequently provide to us, concerning yourself and any other persons, such as name, address, contact telephone, mobile and facsimile numbers, email address, identification details and documents, bank and account and other financial information, survey responses, purchase information, driver’s license number, vehicle preference, model and registration number, debit or credit card number and expiry date, transaction and communication history with us, including any records of your telephone, email or online interactions with us, information about where you collected the car, the date and time of the same and such other personal information that we may process from time to time (collectively “your Personal Data”).

B. IMPACT RESULTING FROM FAILURE TO SUPPLY PERSONAL DATA
You may choose whether or not to provide your Personal Data to us. However, failure to supply such data may result in us being unable to provide the products or services you require. Hence, it is obligatory for you to provide us with your Personal Data when you choose to transact with us.

C. PURPOSES OF COLLECTING AND PROCESSING PERSONAL DATA
We may process your Personal Data for any of the following purpose:

to process your order/transaction and provide the products or services that you request, including delivering your vehicle, customs clearance and doing all things necessary to administer those products or services and manage our relationship with you;
to provide quotations and proposals in response to your request;
for billing and payment processing purposes, including processing credit card payments;
to provide you with the information you have requested and to communicate with you regarding your vehicle, arrangements with us and other matters;
to investigate, prevent and deal with fraud, unlawful or criminal activity and breaches of our agreement with you;
to conduct credit and financial checks;
to research, develop, manage, protect and improve our services and products and for customer service related matters;
to conduct customer satisfaction and market research surveys and inform you of any improvements that we have made to our services;
to provide you with marketing, advertising and promotional information, materials and/or documents relating to products and/or services that we may be selling, marketing, offering or promoting, whether such products or services exist now or may be created in the future;
for our internal record keeping and maintenance and updating of any information database(s);
to maintain and develop our software and other business systems and infrastructure;
to comply with any legal or regulatory requirements or as required or permitted under the PDPA or other laws, rules, regulations, court orders, by-laws, guidelines, circulars or codes (collectively “laws”) applicable to us; (m) where we believe in good faith that the processing is necessary to protect our rights, interests or property; and (n) for any other purpose that is incidental or ancillary to any of the above purposes.

D. DISCLOSURE AND TRANSFER OF PERSONAL DATA
In certain circumstances, we may need to disclose, process and/or transfer your Personal Data for the purposes listed in Section C above. Where we do so, we would merely disclose Personal Data that is necessary for the purpose of such disclosure. We may share your Personal Data with the following persons or entities (whether located within or outside Malaysia) including but not limited to:

any member of the Giga Group of Companies (“Group”), including all related companies, subsidiaries, holding companies and associated companies, our affiliates, licensees and joint venture and programme partners, as well as, employees and officers thereof;
data processing and data storage organisations, technology service providers and organisations that provide other services to us or to whom we outsource certain business operations;
to such entities requiring your Personal Data in connection with certain financing enquiries, customs clearance and any other regulatory approval;
your company or organisation if you use our services under a corporate account;
business partners, agents, suppliers, vendors, subcontractors and service or product providers of any member of the Group as necessary in the course of our operations and to the extent necessary to comply with our obligations to you and/or to provide you with the services or products you have chosen to receive;
third party service and product providers including market research companies, mailing houses and marketing companies that assist us in processing the promotions you have chosen to receive;
banks and other financial institutions;
credit bureaux, referencing or reporting agencies, fraud checking agencies and companies in the financial and information security sector that assist us to detect and prevent fraud;
forwarding agents, insurers and other persons involved in relation to the shipment and delivery of your vehicle;
professionals working on behalf of members of the Group, such as lawyers, auditors, consultants and any other contractors or sub-contractors, as required or permitted by law or as we may determine to be necessary or appropriate;
anybody or person to whom we are compelled or required to do so under any laws or in response to any competent or government, state, provincial, local government, statutory or municipal authority, industry regulator, law enforcement authority, agency or body; and
as we continue to develop our business, we may sell or purchase certain subsidiaries or business units of the Group and we may transfer your Personal Data in connection therewith.

E. ACCESS AND INQUIRIES
You may contact us by writing to us at our email address or postal address below if you wish to request for access to your Personal Data held by us, request that your Personal Data be updated or corrected, or withdraw your consent to the processing of your Personal Data by us. Any inquiries or complaints with respect to your Personal Data should also be communicated to us in the same manner. Please make sure that you include your full name, mailing address, the address where the response should be sent to you and a telephone number where we can reach you.

In respect of your right to access and/or correct your Personal Data, we have the right to refuse such request for the reasons permitted under the applicable laws, such as where the expense of providing access to you is disproportionate to the risks to your privacy. Please note that notwithstanding the withdrawal of your consent, we may still proceed to process your Personal Data in circumstances recognized and permitted by law. Further, if you revoke our ability to use certain personal data, we may not be able to provide certain goods and services to you or this may limit our ability to provide you with the level of service that you would normally expect from us. It is important that your Personal Data is kept up-to-date. Should there be any changes to your Personal Data, kindly update the same with us as soon as possible so that we may update our records.

This Notice may be updated from time to time without prior notice to you. By continuing to communicate with us or by continuing to use our products or services following modifications, updates or amendments to this Notice, this shall signify your acceptance of this Notice and such modification, updates or amendments, and you will be deemed to have accepted this Notice and such modification, updates or amendments.

In the event of any inconsistency or conflict between the English language version and the Malay language version of this Personal Data Notice, the English language version shall prevail.

Acknowledgement & Consent
I declare that all the information which I have provided to Giga Shipping Sdn Bhd are true, accurate and complete. I hereby consent and agree on behalf of myself and all other persons specified in this form (collectively “other persons”) to the collection, processing, use, disclosure and retention by Giga Shipping Sdn Bhd of my Personal Data and the Personal Data of the other persons in the manner as set out in this Personal Data Notice.

Where I have provided Personal Data about the other persons, I have brought this Personal Data Notice to the attention of the other persons, who confirm that they understand, agree and authorize Giga Shipping Sdn Bhd to process their Personal Data in the manner as set out in this Personal Data Notice.
