5. Other business entities, should we plan to merge with or be acquired by that business entity. We do not promise or warrant that any aspect of the sites or system will work properly or that the information provided is complete or accurate or will be continuously available. The Giga Maritime Group website may contain links to third-party websites or resources. You acknowledge and agree that we are not responsible or liable for: (1) the availability or accuracy of such websites or resources; or (2) the content, products or services on or available from such websites or resources. You agree that this Agreement and all agreements and information incorporated herein may be automatically assigned by Giga Maritime Group, in its sole discretion, to a third party. You may not assign your obligations to another entity.

General & Updates

This Agreement does not create any agency, partnership, joint venture, employment or franchise relationship. Our failure to act in a particular circumstance does not waive our right to act with respect to that or other circumstances. We shall be excused for any problem due to a factor beyond our control. If any provision of this Agreement is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of the Agreement will remain in full force and effect, and the provision affected will be construed so as to be enforceable to the maximum extent permissible by law. Any waiver of any provision of this Agreement will be effective only if in writing and signed by Giga Maritime Group.

Terms of Sales

The following terms and conditions of sale shall apply to any sale of goods and services by Giga Maritime Group (hereinafter called “GMG”). Purchaser shall be deemed to have full knowledge of the terms and conditions herein and such terms and conditions shall be binding if either the goods and services referred to herein are delivered to and accepted by Purchaser, or if Purchaser does not within five days from the date hereof deliver to Giga Maritime Group a written objection to said terms and conditions or any part thereof.

General

In the event of any conflict or inconsistency between the terms and conditions of sale herein and the terms and conditions contained in Purchaser’s order or in any other form issued by Purchaser, whether or not any such form has been acknowledged or accepted by Giga Maritime Group, Giga Maritime Group’s terms and conditions herein shall prevail. No waiver, alteration or modification of these terms and conditions shall be binding upon Giga Maritime Group unless made in writing and signed by a duly authorized representative of Giga Maritime Group.

Payment

All prices shall be in Malaysian Ringgit (MYR)

Services & Payment

You should carefully read the item detail page and review information such as price and terms and conditions for sales before purchasing an item. Giga Maritime Group reserves the right in holding back the release of cargo until full payments for services have been made. We take no responsibility and assume no liability for any loss or damages to a buyer arising from shipping information and/or payer information entered by the buyer or wrong remittance by the buyer in connection with the payment for the services rendered.

Cancellation Policy

Should you need to cancel your service request, kindly drop an email to giga.ml.sales@gigaship.com. Depending on whether customs clearance activities have been processed, we will advise on the refund amount which can be credited back to you. In the event that the customs clearance process has begun, we will have to charge a ‘cancellation fee’ which is accorded to the Customs Office.

Payment Terms

Payments are due prior to the vessel departing the Port of Loading with your cargo. Should payment not be made to Giga Maritime Group when due, Giga Maritime Group reserves the right, until the price has been fully paid in cash, to withhold any services rendered to the Purchaser or to hold on the release of cargo at the Port of Discharge.

Changes to this Privacy Policy
